Plenary description: This presentation will center on the increasing use of commander in chief powers such as the Alien Act as well as the use of the military and other national security functions for routine duties and what the state of the law is regarding these uses. It will try to cut through hyperbole in the press and provide meaningful examples of where an administration will test norms and either be constrained or create new norms through formal rulings or judicial and legislative acquiescence.
