Disputes over recreational stream access involve fundamental disagreements between landowners and boaters/anglers about public use of stream waters, beds and banks. These disputes have been litigated in New Mexico and other western states, and courts have focused on public ownership of waters in deciding these cases. This talk examines stream access decisions in the West, including the New Mexico Supreme Court's 2022 decision in Adobe Whitewater.
